Privacy and data protection
Data protection is a matter of trust and your trust is important to us. To ensure that you feel secure when visiting our website, we strictly observe the statutory provisions when processing your personal data and would like to inform you here about our data collection and use of data. The following privacy policy explains what data is collected from you on our websites and which of this data we process and use in what way and who you can contact with any concerns.
1. Controller and rights of the data subject
You have a right to free information about the personal data we have stored about you and, if applicable, a right to rectification, restriction of processing, data portability or erasure of this data. If you have any questions about the collection, processing or use of your personal data, for information, correction, blocking or deletion of data as well as revocation of consents granted or objection to a specific use of data, please contact us directly using the contact details in our imprint, and you also have the right to complain to the responsible data protection supervisory authority.
2. Collection, processing and use of personal data
Personal data is information about the factual or personal circumstances of an identified or identifiable natural person. This includes, for example, your name, your telephone number, your address and all inventory data that you provide to us when you register and create your customer account.
2.1 Customer account
We set up a customer account for every customer who registers with us using the "register now" function, i.e. password-protected direct access to their inventory data stored by us. Here you can, among other things, view data about your completed, open and recently dispatched orders or manage your personal data and the newsletter.
2.1.1 Setting up a customer account and completing an order
The following data must be provided when registering for a customer account and completing an order (mandatory information): Your email address
Your password
Your first name
Your surname
Your gender
Your date of birth
Your place of residence for the purpose of parcel delivery
Consent to credit check and privacy policy
We require your correct name, address and payment details for your order. We need your e-mail address so that we can confirm receipt of your order and its dispatch and generally so that we can communicate with you. We also use your e-mail address to identify you (as your login name) when you log in to your customer account.
2.2 Collection, processing and use of your personal data
We collect, store and process your data for the entire processing of your purchase, including any subsequent warranties, for our services (e.g. customer complaints), technical administration, our own marketing purposes (more information on this under point 2.3) and for the prevention of criminal offences and fraud. Your personal data will only be passed on to third parties to the extent permitted by law, including for the purpose of contract processing or billing, for marketing purposes or if you have given your prior consent. As part of order processing, for example, the service providers we use (such as carriers, logistics companies, banks) receive the necessary data for order and order processing. The data passed on in this way may only be used by our service providers to fulfil their task.
2.3 Use of your data for advertising purposes
In addition to processing your data to process your purchase at zigarrenversand.ch, we also use your data for the following purposes: to constantly improve your shopping experience and make it customer-friendly and personalised for you; to communicate with you about your orders and about specific products or marketing campaigns; and to recommend products or services that may be of interest to you. We use existing information for this purpose, such as confirmations of receipt and read receipts of e-mails, information about the end device you are using, your connection to the Internet, operating system and platform, date and time of your visit to the homepage, or products you have viewed, as well as information that we have received from you (including automatically transmitted or generated information). We also use your order history.
You can object to the use of your personal data for advertising purposes at any time, either as a whole or for individual measures, without incurring any costs other than the transmission costs according to the basic rates. A notification in text form to the contact details stated under point 1 (e.g. e-mail, fax, letter) is sufficient for this.
2.3.1 Newsletter
To send the newsletter, we use the e-mail address you have provided and require your confirmation that you, as the owner of the e-mail address, agree to receive it.
If you no longer wish to receive newsletters from us, you can object to this at any time without incurring any costs other than the transmission costs according to the basic rates. A message in text form to the contact details mentioned under point 1 (e.g. e-mail, fax, letter) is sufficient for this. Of course, you will also find an unsubscribe link in every newsletter.
2.3.2 Product evaluation mail
If you have made a purchase on zigarrenversand.ch, you will receive a product evaluation e-mail from us. You will receive this product review email from us regardless of whether you have subscribed to a newsletter. In this way, we want to give you the opportunity to communicate your satisfaction with the product
2.3.3 Banner advertising
We also use the data collected during your visit to show you so-called banner adverts. These are adverts that we place on third-party websites. This is usually done using cookies or pixels. Our aim is to make the advertising offer more useful and interesting for you, which is why you will primarily see products that you have either already viewed on our site or products that are similar to the products you have viewed (so-called retargeting) as part of the banner advertising. We only work with pseudonymised data in the context of banner advertising; plain text information about you (e.g. your name or email address) is not stored in the cookies.
You can find more information on cookies, pixels and retargeting in sections 4 and 7 of this policy.
3. Credit assessment
If we make advance payments, e.g. in the case of a purchase on account, we may obtain credit information from a credit agency (CRIF AG) on the basis of mathematical-statistical procedures in order to safeguard our legitimate interests. For this purpose, we transmit the personal data required for a credit check to a credit agency CRIF AG and use the information received on the statistical probability of a payment default for a balanced decision on the establishment, execution or termination of the contractual relationship.
Consent can be revoked at any time with effect for the future.
Credit agency: Crif AG, Hagenbolzstrasse 81, 8050 Zurich, https://www.crif.ch

4. Cookies
Accepting cookies is not a prerequisite for visiting our website. However, we would like to point out that our website and service will only have limited functionality if you do not allow us to set cookies.
What are cookies?
Cookies are small files that are stored on your data carrier and that save certain settings and data for exchange with our system via your browser. There are basically 2 different types of cookies, so-called session cookies, which are deleted as soon as you close your browser, and temporary/permanent cookies, which are stored on your data carrier for a longer period of time or indefinitely. This storage helps us to customise our websites and our offers for you and makes it easier for you to use them, for example by saving certain entries you make so that you do not have to keep repeating them.
Which cookies does Zigarrenversand.ch use?
Most of the cookies we use are automatically deleted from your hard drive at the end of the browser session (hence session cookies). Session cookies are required, for example, to offer you the shopping basket function across several pages. We also use cookies that remain on your hard drive. On a subsequent visit, it is then automatically recognised that you have already visited us and which entries and settings you prefer. These temporary or permanent cookies (lifespan 1 month to 10 years) are stored on your hard drive and delete themselves after the specified time. These cookies in particular serve to make our website more user-friendly, effective and secure. Thanks to these files, it is possible, for example, to display information on the site that is specifically tailored to your interests. The sole purpose of these cookies is to customise our website to best meet your needs and to make your browsing experience as convenient as possible.
What data is stored in the cookies?
Only pseudonymous data is stored in the cookies used by Zigarrenversand.ch. When the cookie is activated, it is assigned an identification number and your personal data is not assigned to this identification number. Your name, IP address or similar data that would allow the cookie to be directly assigned to you are not stored in the cookie. Based on the cookie technology, we only receive pseudonymised information, for example about which pages of our shop have been visited, which products have been viewed, etc.
Are there also cookies from third-party providers (so-called third-party cookies)?
Zigarrenversand.ch uses a number of advertising partners who help to make the Internet offer and the websites more interesting for you. For this reason, cookies from partner companies are also stored on your hard drive when you visit the websites. These are temporary/permanent cookies that are automatically deleted after the specified time. These temporary or permanent cookies (lifespan 14 days to 10 years) are stored on your hard drive and delete themselves after the specified time. The cookies of our partner companies also only contain pseudonymised, usually even anonymous data. This includes, for example, data on which products you have viewed, whether something has been purchased, which products have been searched for, etc. Some of our advertising partners also collect information beyond the websites about which pages you have previously visited or which products you were interested in, for example, in order to be able to show you advertising that best matches your interests.
Re-targeting
Our websites use so-called re-targeting technologies. We use these technologies to make our website more interesting for you. This technology makes it possible to target internet users who have already shown an interest in our shop and our products with adverts on our partners' websites. We are convinced that the display of personalised, interest-related advertising is generally more interesting for the Internet user than advertising that has no such personal reference. These advertisements are displayed on our partners' websites on the basis of cookie technology and an analysis of previous user behaviour. This form of advertising is completely pseudonymous. When you use our website, cookies are used to collect, store and utilise your usage data. Furthermore, your data is stored in cookies beyond the end of the browser session and can, for example, be called up again the next time you visit the website.
How can you prevent the storage of cookies?
You can set your browser to only accept the storage of cookies if you agree to this and thus prevent the future storage of cookies. If you only want to accept the Zigarrenversand.ch cookies but not the cookies of our service providers and partners, you can select the "Block third-party cookies" setting in your browser.
As a rule, the help function in the menu bar of your web browser will show you how you can reject new cookies and switch off cookies you have already received.
5. Log files
Every time the pages of Zigarrenversand.ch are accessed, usage data is transmitted by the respective Internet browser and stored in log files, the so-called server log files. The stored data records contain the following data: Date and time of access, name of the page accessed, IP address, referrer URL (origin URL from which you came to the web pages), the amount of data transferred, as well as product and version information of the browser used. We analyse these log file data records in order to further improve our offer and the Zigarrenversand.ch shop and make it more user-friendly, to find and rectify errors more quickly and to control server capacities. At the same time, we use the log file data records to defend against attacks on our Zigarrenversand.ch shop, e.g. in the context of so-called distributed denial-of-service attacks, which aim to block access to our Zigarrenversand.ch shop by overloading it with requests.
6. Web analysis
In order to constantly improve and optimise our offer, we use so-called tracking technologies. We use the services of Google Analytics for this purpose.
6.1 Google Analytics
This website uses Google (Universal) Analytics, a web analytics service provided by Google Inc (www.google.ch). Google (Universal) Analytics uses methods that enable your use of the website to be analysed, such as so-called "cookies", text files that are stored on your computer. The information generated about your use of this website is usually transferred to a Google server in the USA and stored there. By activating IP anonymisation on this website, the IP address is shortened before transmission within the member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there. The anonymised IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.
You can prevent Google from collecting the data generated by the cookie and relating to your use of the website (including your IP address) and from processing this data by Google by downloading and installing the browser plug-in available at the following link: http://tools.google.com/dlpage/gaoptout?hl=en. As an alternative to the browser plugin, you can click this link to prevent Google Analytics from collecting data on this website in the future. An opt-out cookie will be stored on your end device. If you delete your cookies, you must click the link again.
7. Retargeting and data collection by third parties for banner advertising
As part of retargeting and banner advertising, we use third-party services that set cookies on our website. These are the following providers: Google, Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA; https://www.google.de/intl/de/policies/technologies/ads/
8. Secure data transmission
Your personal data is transmitted securely by us using encryption. This naturally also applies to your order and the customer login. We use the TLS (Transport Layer Security) or SSL (Secure Socket Layer) coding system. We also use technical and organisational measures to protect our websites and other systems against loss, destruction, access, modification or dissemination of your data by unauthorised persons.
