AGB zigarrenversand.ch gmbh
1. Validity
The General Terms and Conditions (GTCs) of zigarrenversand.ch gmhb, which are reproduced below, apply to legal transactions on www.zigarrenversand.ch, www.humidorshop.ch and www.pfeifentabak.ch. These GTCs apply to all business relationships between zigarrenversand.ch gmhb (hereinafter: seller) and the customer (hereinafter: buyer). The seller is free to decide with which buyer it enters into business relations.
2. Confirmation of customer data
By accepting these GTCs, the Buyer confirms that the data provided by him/her is true. In particular, he confirms that he is at least 18 years old at the time of registration. If untrue information provided by the buyer results in damage to the seller, this will be passed on to the buyer.
3. Health warnings
The buyer confirms that he/she is aware of the risks and consequences of tobacco consumption. The buyer is aware of the health warnings issued by the Federal Office of Public Health (FOPH) regarding tobacco consumption. These can be viewed on the relevant FOPH website. The seller expressly disclaims any responsibility and liability for damage to the buyer's health.
4. Data protection
The data collected from the Buyer shall be treated confidentially and in good faith by the Seller. The data will only be disclosed to third parties on the basis of a legal obligation. The buyer agrees that his name and address may be disclosed to third parties for the purpose of sending the ordered products. The buyer agrees that the seller may disclose his data to third parties for the purpose of enforcing its claim.
The confidentiality of content transmitted by e-mail is not guaranteed. The Buyer is aware that the Seller accepts no liability for the security of data transmitted via the Internet.
5. Offer and conclusion of contract
The offer is non-binding. Delivery only while stocks last. All prices quoted are in Swiss francs (CHF) and include VAT. Depending on the value of the shopping basket, a flat-rate shipping fee is charged, which is defined under Shipping. The illustrations of the products and their description are without guarantee. Errors and price changes excepted.
The presentation of the products does not constitute a legally binding offer, but an invitation to the customer to place a binding order (offer to conclude a contract)
By clicking on the order button, the customer places a binding order for the products listed on the order page.
Immediately after receipt of the order, the seller confirms receipt of the order by e-mail. The purchase contract is only concluded when the seller confirms the dispatch of the goods by email (order or dispatch confirmation) or at the latest by delivery of the goods.
In the case of payment in advance, the purchase contract is concluded upon confirmation of receipt of the advance payment by the seller
6. Dispatch
Shipping costs
We charge a flat rate of CHF 7.50 per order for delivery within Switzerland and the Principality of Liechtenstein. From an order value of 80 CHF we deliver free of charge within Switzerland.
Shipping methods
You can choose between SwissPost Priority and SwissPost Priority Signature. Between Thursday 18:00 and Friday 18:00, Saturday delivery is available free of charge. With standard delivery, the parcel is deposited in the drop box as far as possible - without a signature. Neither Post AG nor zigarrenversand.ch GmbH accept any liability for lost consignments in this case. With the Signature shipping method, the parcel will only be handed over against signature. If delivery is unsuccessful, the parcel must be collected from the nearest post office against a signature. For security reasons, consignments with a value of more than CHF 500 are always sent using SwissPost Signature.
Dispatch time
Items are dispatched on weekdays between Monday and Friday. Orders received by 18:00 will be dispatched on the same day, provided all items are in stock.
7. Payment
Payment by invoice
When paying by invoice, the invoice amount must be paid within 20 days of the invoice date.
After this period has expired, a payment reminder will be sent by e-mail. The second reminder will be sent by e-mail and letter post with a fee of CHF 5.00. The third reminder will be sent by e-mail and letter post with a fee of CHF 30.00.
The maximum order value per invoice is CHF 500.00. If the invoice is not paid after the 3rd reminder, we reserve the right to instruct a debt collection agency to enforce our claim, which will incur additional charges. You will also be informed that the application/order data you provide will be sent to CRIF AG in Zurich to check your identity and creditworthiness. Payment in advance
If payment is made in advance, payment must be received by the seller within seven days. After this period, the order will be cancelled without comment.
Cash payment
If you pick up your order in Schaffhausen, you have the option of paying cash in the shop. Cash payment can already be registered during the ordering process with the corresponding payment method in the checkout.

The seller expressly reserves the right to change the payment conditions in individual cases. The seller also reserves the right to no longer enter into a business relationship with insolvent buyers and those who have not fulfilled their payment obligations or have fulfilled them too late or have otherwise behaved dishonestly. We subject first-time customers to a credit check. If this reveals that the customer has or has had debt collection proceedings, the seller reserves the right to make the delivery of orders dependent on advance payment. In this case, the customer will be informed in advance and can also cancel the purchase if desired.

9. Retention of title
The ordered product remains the property of the seller until full payment has been received.
10. Guarantee declaration
The seller obtains the products offered exclusively from importers who import them through official channels. It guarantees the flawless quality and authenticity of the products.
11. Right of cancellation - right of return and exchange
We grant a right of cancellation with restrictions on individual cigars.
Cigars and tobacco products
Single cigars or cigars shipped open cannot be returned or exchanged.
Whole boxes can be returned provided the protective film has not been removed.
If the buyer does not agree with the quality of the product when ordering boxes and if the quality defect is comprehensible to the seller and is not attributable to the buyer, the box will be replaced free of charge. In this case, the Buyer must contact the Seller and return the rejected product to the Seller within 7 days at the Seller's expense.
The buyer has the option of returning the order (with the exception of single cigars or cigars that are openly packaged) within 14 days of the invoice date by registered letter with reasons. However, the right of return only applies if the items ordered are unused, unopened, in their original packaging and in perfect condition. The return is at the expense of the buyer.
Reduced goods or goods in liquidation cannot be returned.

13. Loyalty points
The seller reserves the right to make changes of any kind to the loyalty points programme. Loyalty points cannot be paid out in cash and there is no entitlement to the points. If orders are returned or cancelled, the points will also be cancelled. The points will be credited after receipt of payment and dispatch of the order.
14. Vouchers
Vouchers can only be redeemed at www.zigarrenversand.ch. The individual code must be entered in the shopping basket. A maximum of CHF 3000 per order and customer can be spent with vouchers. Shipping costs are excluded from the voucher.
15. Protection of minors
If your order includes goods whose sale is subject to age restrictions, we use a reliable procedure involving a personal identity and age check to ensure that the customer has reached the required minimum age. The deliverer will only hand over the goods after an age check has been carried out and only to the customer personally.
16. Amendment of the GTC
The seller reserves the right to amend the GTC at any time. The current version of the GTC is available at www.zigarrenversand.ch. The GTC accepted at the time of the order shall apply to the buyer.
17. Place of jurisdiction
The exclusive place of jurisdiction is Schaffhausen.
18. Applicable law
Swiss law shall apply exclusively. The Vienna Sales Convention shall not apply.
